Pledge Report: Institutional Strengthening for IHL Implementation

CADIH was set up following ICRC guidelines to facilitate the process of implementing IHL domestically. It advises and assists the government in its efforts to ensure the effective application of IHL.

CADIH was created by Decree 677/992, which was amended by Decree 208/996. It is chaired by the Ministry of Foreign Affairs and includes representatives from the defence, interior, health, and education and culture ministries and from the Supreme Court of Justice, the Law Faculty of the University of the Republic (Udelar), the Uruguayan Red Cross and the Catholic University of Uruguay (UCU).

This group of representatives from the public sector and academia studies IHL issues and formulates recommendations on the dissemination and teaching of IHL at all levels of education and promotes IHL implementation and compliance through the adoption of the laws, regulations and measures required to achieve these goals.

The decree establishing CADIH specifies that the purpose of the committee is to study IHL issues and draw up recommendations on the following:

  1. a) dissemination and teaching of the Geneva Conventions and their Additional Protocols, ratified by Uruguay in Act 13,683 of 17 September 1968 and Act 15,764 of 13 September 1985 respectively, at all levels of state and private education
  2. b) practical implementation and enforcement of IHL through laws, regulations and measures that ensure the effective application of the above-mentioned treaties.

Uruguay has legislated on IHL matters, enacting laws to provide answers in cases of human rights and IHL violations and to prosecute and punish those responsible.
