Pledge on promotion and strengthening of the work of the National Committees on International Humanitarian Law, as well as for the exchange of information among them // Promesa sobre promoción y fortalecimiento del trabajo de las Comisiones Nacionales de Derecho internacional humanitario, así como para el intercambio de información entre ellas

A) Objectives of the pledge:

The States recognize the important work that National Committees on International Humanitarian Law (IHL) have accomplished in recent decades in order to promote the spreading, knowledge and implementation of rules and principles of IHL.

 

We underline their relevance as spaces for technical assistance, study and formulation of initiatives for the implementation and application of IHL in their countries.

 

We consider their importance of promoting and dissemination of IHL, guiding their actions to diverse actors such as armed and police forces, prosecutors, judges, public officials, lawyers, researchers, professors, university authorities, students, among others.

 

We recognize the existence of ostensible progress in their work, therefore it is necessary to encourage the creation of spaces for the exchange of information or experiences and good practices among different national committees on IHL, through regional or bilateral meetings, especially through digital media, consequently we encourage the use of the new digital community for national committees and similar entities on IHL.

 

Therefore, we are committed to strongly promote the strengthening of national committees on IHL in order to encourage their implementation, and to share good practices and other measures among countries.

Los Estados reconocemos la importante labor que las Comisiones Nacionales de Derecho internacional humanitario (DIH) han cumplido en las últimas décadas para impulsar la difusión, conocimiento e implementación de las normas y principios del DIH.

 

Subrayamos su relevancia como espacios de asistencia técnica, estudio y formulación de iniciativas para la implementación y aplicación del DIH en los respectivos países.

 

Consideramos su importancia en la promoción y difusión del DIH, orientando sus acciones a una multiplicidad de actores como las fuerzas armadas y policiales, fiscales, jueces, funcionarios públicos, abogados, investigadores, profesores, autoridades universitarias, estudiantes, entre otros.

 

Reconocemos la existencia de avances ostensibles en su trabajo, por lo que resulta necesario fomentar la creación de espacios para el intercambio de información entre las distintas comisiones, a través de reuniones regionales o bilaterales de comisiones de DIH o intercambio de experiencias y buenas prácticas, especialmente a través de medios digitales, por lo que alentamos la utilización de la nueva comunidad digital para comisiones nacionales de DIH y organismos afines.

 

Por lo tanto, nos comprometemos a promover decididamente el fortalecimiento de las comisiones nacionales de DIH para fomentar su implementación, y compartir buenas prácticas entre los países, entre otras medidas.

 

B) Action plan:

  1. IHL implementation at the national legal frameworks:

 

– Review the IHL treaties to which the State is not yet party and evaluate the relevance of promoting their ratification.

 

-Advise national authorities on measures to implement IHL, including regulatory nature, public policies, dissemination, among others.

 

-Promote the incorporation of international regulations on International Humanitarian Law at the national legal scope.

 

  1. Dissemination of IHL:

 

-Promote the dissemination of IHL and increase the number of trainings, through different measures, for actors such as armed and police forces, prosecutors, judges, public officials, lawyers, researchers, professors, university authorities, students, among others.

 

-Work with the academia to strengthen the dissemination of IHL in the States.

 

-Organize meetings of experts and events of dissemination to generate exchanges among different actors involved with IHL.

 

  1. Exchange of information:

 

-Participate in regional and universal meetings of national committees on IHL, whenever possible.

 

-Promote the exchange of information among national committees.

 

-Promote the participation of national committees on IHL in the digital community for national committees and similar entities on IHL, promoted by the ICRC.

  1. Implementación del DIH en los marcos jurídicos internos:

 

-Revisar los tratados de DIH de los que el Estado aún no es Parte y evaluar la pertinencia de promover su ratificación.

 

-Asesorar a las autoridades nacionales en las medidas de implementación del DIH, de carácter normativo, de políticas públicas, difusión, entre otras.

 

-Promover la incorporación de la normativa internacional en materia de Derecho Internacional Humanitario a los ámbitos jurídicos -nacionales.

 

  1. Difusión del DIH:

 

-Promover la difusión del DIH y el incremento del número de capacitaciones a actores como las fuerzas armadas y policiales, fiscales, jueces, funcionarios públicos, abogados, investigadores, profesores, autoridades universitarias, estudiantes, entre otros, a través de distintas medidas.

 

-Trabajar con la academia para el fortalecimiento de la difusión del DIH en los Estados.

 

-Organizar reuniones de expertos y eventos de difusión para generar intercambios entre los distintos actores involucrados con el DIH.

 

  1. Intercambio de información:

 

-Participar en las reuniones regionales y universales de las comisiones nacionales de DIH, siempre que sea posible.

 

-Impulsar el intercambio de información entre las comisiones nacionales.

 

-Impulsar la participación de las comisiones nacionales de DIH en la comunidad digital para comisiones nacionales de DIH y organismos afines, promovida por el CICR.

C) Indicators for measuring progress:

-Number of meetings held by the national committee on IHL per year.

 

-Number of proposals, at the national level, legislation, policies or procedures related to IHL.

 

-Number of trainings, meetings of experts, working groups, among other activities related to IHL.

 

-Number of exchanges of information, in person or digital form, among national committees on IHL.

 

-Number of follow-up reports related to the progress on IHL.

D) Resource implications:

The States will determine the resources that may be required to carry out this pledge based on the objectives and actions they choose to take in their specific context.

 

Moreover, the States may rely on different organizations such as the International Committee of the Red Cross to implement the action plan.

Los Estados determinarán los recursos que podrían necesitarse para concretar esta promesa sobre la base de los objetivos y las acciones que elijan emprender en su contexto en particular.

 

Asimismo, los Estados podrán apoyarse para el cumplimiento del plan de acción en distintas organizaciones, como, por ejemplo, en el Comité Internacional de la Cruz Roja.
