Norway pledge on review of existing Norwegian Defence Sector implementation of Additional Protocol I to the Geneva Conventions article 36

A) Objetivos de la promesa

Norway is a party to the Additional Protocol I of 1977 to the Geneva conventions of 1949 (AP I). The obligations under AP I article 36, is implemented within the Norwegian Defence Sector, by the “Norwegian Ministry of Defence, Directive on the Legal Review of Weapons, Methods and Means of Warfare”, of June 18th 2003, and supplementary measures.

 

Identification of relevant International Law obligations before and during the Norwegian Defence Sector development, acquisition or adoption of new weapons, means or methods of warfare, ensure IHL obligations guide development, acquisition and employment of such capacities. Norway therefore see AP I article 36 reviews as one of several important means to ensure compliance with IHL.

 

The AP I art 36 legal review mechanism first introduced in 1994 has been subject to review and changes in 1998 and 2003. As time has passed since 2003, organizational changes within the Norwegian Defence Sector has taken place. It is vital to ensure the Norwegian Defence Sector legal review mechanism function as intended. The Ministry of Defence therefore reviewed its existing Norwegian Defence Sector implementation of AP I article 36 in 2019, and identified potential improvements.

 

B) Plan de acción

Norway will enhance existing Norwegian Defence Sector implementation of AP I article 36, by implementation of identified improvements to the legal review mechanism.

Implementation of this pledge will follow the internal Norwegian Ministry of Defence process of reviewing the AP I article 36 legal review mechanism.

 

D) Recursos requeridos:

Implementation of this pledge will be based on Norwegian Ministry of Defence resources.
