Enhancing protection of specific groups in vulnerable situations in armed conflicts, disasters and other crises

أ) أهداف التعهد

Humanitarian crises can render individuals vulnerable or exacerbate their pre-existing vulnerability and marginalization. Specific groups in vulnerable situations (such as women, children, LGBTI persons, persons with disabilities, elderly persons, refugees and other forcibly displaced persons, persons belonging to religious or ethnic minorities) are affected by crises, disasters and armed conflicts in different ways and have differentiated needs. It is important to acknowledge the existence of intersecting vulnerabilities and inequalities that need to be addressed in a comprehensive manner.

Recalling UN Security Council Resolution 2467 (2019) on sexual violence in conflict, UN Security Council Resolution 2474 (2019) on missing persons in armed conflicts, UN Security Council Resolution 2475 (2019) on the situation of persons with disabilities in armed conflict and humanitarian crises, UN Security Council Resolutions on Children and Armed Conflicts (1261 (1999), 1314 (2000), 1379 (2001), 1460 (2003), 1539 (2004), 1612 (2005), 1882 (2009), 1998 (2011), 2068 (2012), 2143 (2014), 2225 (2015), 2427 (2018), 2601 (2021), UN Security Council Resolution 1325 (2000) on Women Peace and Security, and in line with their commitments to the Call to Action Road Map 2021-2025, the EU Action Plan on Integration and Inclusion 2021-2027 and the EU Strategy for the Rights of Persons with Disabilities 2021-2030, and the EU council conclusions on protection in humanitarian settings

The EU and its Member States, in accordance with their respective competences, pledge to:

  • advocate for the compliance with international guidelines, such as the Inter-Agency Standing Committee Policy on Protection, the Inter-Agency Standing Committee Guidelines on Inclusion of Persons with Disabilities in Humanitarian Action, the Inter-Agency Standing Committee Handbook on Gender in Humanitarian Aid, the Inter-Agency Standing Committee GBV Guidelines, the IASC Gender with Age Marker, the IASC Guidelines on Mental Health and Psychosocial Support in Emergency Settings, the Inter-Agency Child Protection Minimum Standards, the Inter-agency Guiding principles on Unaccompanied and Separated Children and the Safe Schools Declaration;
  • support and prioritize good quality, safe programming and monitoring, and the maximisation of the protective impact of humanitarian action;
  • encourage National IHL Committees and similar entities to launch initiatives and raise awareness and to take national legislative and policy measures on protection of specifics groups in vulnerable situations in armed conflict and encourage exchange of good practice and technical support among States in this regard;
  • take measures to address gender inequalities and promote the empowerment, full, equal and meaningful participation of women and girls as well as their organisations, by including them and demanding their inclusion in decision-making and operational processes in humanitarian and stabilization projects as well as in civilian-military cooperation in armed conflict where appropriate;
  • integrate the specific barriers and risks faced by persons with disabilities from military operations in international humanitarian law dissemination activities;
  • organize when appropriate expert exchanges between State armed forces and persons with disabilities and their representative organizations (OPDs) with a view to raise awareness and to examining how the specific barriers and risks faced by persons with disabilities in military operations in armed conflict may be integrated in military training, education, doctrine, planning and conduct of military operations, and potential after-action reviews;
  • take measures to promote the meaningful participation of persons with disabilities in the decision-making processes and implementation of international humanitarian law and more broadly, humanitarian projects;
  • strengthen measures to protect children from the effects of armed conflict and ensure accountability for crimes against them;
  • take steps to improve the integration of gender and aged-specific risks, with special focus on children in civilian harm reduction and mitigation policies, for example by appointing gender advisers and persons with child protection expertise to positions of influence in armed forces, and including the specific barriers and risks faced by children, as well as the barriers and risks due to gender inequality in military training, education, doctrine, planning and conduct of military operations, and potential after-actions reviews;
  • strengthen the collection and dissemination of disaggregated data on sex, age and disability in humanitarian projects and screen, when feasible, all humanitarian funding proposals with regard to their gender-, age-, and disability -responsive design and implementation;
  • strengthen institutional women, peace and security (WPS) capacities at the international and regional level, including the IHL aspects of WPS capacities, in particular by contributing funds to relevant UN initiatives;
  • strengthen the prevention and response to all forms of sexual and gender-based violence by addressing the root causes and increasing the protection of women and girls, as well as men and boys, in fragile environments and/or conflict-affected contexts through a survivor-centered and gender sensitive approach, considering the specific vulnerabilities of diverse victims and survivors, including children born of sexual violence in armed conflict;
  • prioritize safe and dignified access to medical, mental health, social, economic, and legal services for all victims and survivors while working to reduce community stigma which hinders their recovery and reintegration into community life, as well as enhance efforts to eliminate sexual and gender based violence by improving national legislation prohibiting sexual violence in conflict against all persons, ensuring effective and ethical reporting mechanisms for victims and survivors, strengthening justice including restorative justice, and holding perpetrators to account;
  • ensure that actions which aim to protect specific groups in vulnerable situations are provided with medium- and longer-term sustainability through the Humanitarian-Development-Peace nexus approach, i.e. through ensuring continuity, follow up and complementarity in development programming and supports to conflict prevention and peacebuilding in an inclusive and conflict sensitive manner;
  • enhance national implementation of IHL and support efforts to prevent persons from going missing in armed conflict, including by accounting for persons in the hands of an opposing party and establishing national information bureaux; search for missing persons and inform their families; and identify and manage the dead in a dignified manner, including by strengthening the capacity of medico-legal institutions.

ب) خطة العمل:

The EU and its Member States, in accordance with their respective competences, intend to:

  • continue to advocate for protection, full, equal and meaningful inclusion of all individuals, mindful of possible intersecting vulnerabilities;
  • continue their work to collect and share data on sex, age and disability in order to acquire reliable data on the inclusion of all persons affected by crises and the differentiated impacts of crises on all persons;
  • continue to advocate and take action to prevent and respond to the six grave violations against children in armed conflict;
  • continue to use their role in the respective bodies and organs of humanitarian organizations to advocate for gender- and age-sensitive humanitarian programming and recruitment, which meets the differentiated needs of women, girls, boys and men of all ages;
  • continue to advocate, as appropriate, in the prevention and response to victims of gender-based violence in line with the international commitments and specifically within the Call to Action on Protection from gender-based violence in emergencies;
  • advocate to ensure meaningful protection of persons with disabilities in emergencies, particularly in situations of armed conflict, strive to provide accessible and inclusive protection and assistance, and strive towards the inclusion of organisations of persons with disabilities (OPDs), including local actors, in relevant humanitarian awareness-raising events or discussions;

engage, together with National Societies as deemed appropriate, in dialogue with the ICRC on the establishment and/or functioning of National Information Bureaux as well as on their technical coordination with the ICRC’s Central Tracing Agency for the purpose of transmission of information on protected persons in the hands of a party to an international armed conflict; and ensure processes to account for these protected persons are integrated into operational planning linked to detention and to the management of deceased military personnel on the battlefield.
